These Terms of Service ("Terms") govern your access to and use of the website https://digitaldevelopers.in and the marketing services provided by Digital Developers, a real estate marketing agency based in Nashik, Maharashtra, India.

By accessing our website, contacting us, or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

Digital Developers provides real estate digital marketing services including, but not limited to:

• Meta (Facebook & Instagram) advertising campaign setup and management
• Sales team training, call scripts, and follow-up systems
• Site visit conversion strategy and lead nurturing
• Content creation, project shoots, reels, and social media management
• Marketing audits and free consultations

Specific deliverables, timelines, and scope are defined in a separate service agreement, proposal, or written confirmation agreed between you and Digital Developers before work begins.

Our services are intended for real estate developers, brokers, channel partners, and business entities operating in India. By using our services, you represent that you are at least 18 years of age and have the authority to enter into a binding agreement on behalf of yourself or your organisation.

We offer free 30-minute consultations to discuss your real estate marketing needs. These consultations are provided for informational purposes and do not create a binding service contract unless explicitly agreed in writing.

Advice shared during consultations is based on information you provide and our professional experience. Results from implemented strategies may vary based on market conditions, project quality, sales team performance, pricing, and other factors outside our control.

Service fees, ad management charges, and payment terms are agreed separately for each client engagement. Unless otherwise stated in writing:

• Meta ad spend is separate from our management fees and is paid directly to Meta or as agreed in your service contract.
• Minimum recommended Meta ad budget starts from Rs. 500/day for campaign viability.
• We maintain transparent billing with no hidden charges beyond what is agreed in your proposal.
• Invoices are payable within the timeframe specified in your service agreement.
• Late payments may result in paused campaigns or suspended services until outstanding amounts are cleared.

To deliver effective results, clients agree to:

• Provide accurate project information, pricing, RERA details, and marketing assets.
• Grant timely access to ad accounts, social media pages, and sales teams as required.
• Respond to leads and follow up on site visit bookings within agreed timelines.
• Ensure all property listings and promotional content comply with RERA and applicable advertising laws.
• Not use our services for misleading, fraudulent, or illegal real estate promotions.

Campaign performance depends significantly on sales team execution, product-market fit, and project readiness. We are not responsible for closed deals if the client fails to follow agreed follow-up processes.

All content on this website — including text, design, logos, graphics, and code — is owned by Digital Developers or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute website content without prior written permission.

Marketing creatives, ad copy, training materials, and content produced specifically for your project remain subject to the ownership terms in your service agreement. Unless otherwise agreed, Digital Developers retains the right to showcase anonymised campaign results and creatives in its portfolio and marketing materials.

Digital Developers focuses on generating qualified leads, site visits, and sales-ready prospects — not guaranteed flat sales. We do not guarantee specific lead volumes, conversion rates, or revenue outcomes.

Real estate marketing results depend on ad spend, market demand, location, pricing, competition, sales team quality, and project reputation. Past performance of other clients does not guarantee similar results for your project.

Testimonials, statistics, and case references on our website or social media represent illustrative outcomes and should not be interpreted as promises of future performance.

Our services utilise third-party platforms including Meta (Facebook/Instagram), WhatsApp, and other tools. Your use of these platforms is subject to their respective terms and policies. We are not responsible for platform outages, policy changes, ad account restrictions, or account suspensions imposed by third-party providers.

You are responsible for maintaining compliant ad accounts and business pages in good standing with Meta and other platforms.

To the maximum extent permitted by applicable law, Digital Developers and its founder, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services.

Our total liability for any claim arising from a specific service engagement shall not exceed the total fees paid by you to Digital Developers for that engagement in the three (3) months preceding the claim, unless otherwise required by applicable law.

Either party may terminate a service engagement as per the terms of the applicable service agreement. We reserve the right to suspend or terminate services immediately if you breach these Terms, engage in fraudulent activity, or use our services in violation of law or platform policies.

Upon termination, you remain responsible for fees incurred up to the termination date and any outstanding ad spend obligations.

These Terms are governed by the laws of India. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Nashik, Maharashtra, India.

Before initiating legal proceedings, both parties agree to attempt to resolve disputes amicably through good-faith negotiation for a period of thirty (30) days.

We may revise these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the website after changes constitutes acceptance. For active service engagements, material changes will be communicated where reasonably practicable.
